Waste Electrical Appliances Retrieval Requires Record Difficult to Be Traced Up to Penalty

In order to protect the environment and standardize the recycling market for electronic products, the Ministry of Commerce of the People's Republic of China has recently drafted the “Administrative Measures for the Recycling of Waste Electrical Appliances and Electronic Products (Draft for Solicitation of Comments)” and announced it on the website of the Legal Affairs Office of the State Council for extensive solicitation of social opinions. The Measures stipulate that the recycling of waste electrical and electronic products must establish a traceability system for recycling and delivery records. If the records and flow direction are not clear and cannot be traced, the maximum penalty is 10,000 yuan.

The Opinions stipulate that the State shall implement the filing system for the management of waste electrical and electronic product recycling operations. The competent commercial authorities at the county level or above are the record-keeping agencies for the recycling of waste electrical and electronic products. Those who engage in waste electrical and electronic recovery business activities and fail to file records according to regulations will be fined a maximum of 10,000 yuan.

Recycling of waste electrical and electronic products should establish a traceability system for recycling and delivery records. The transfer record should list the source, type, brand, model, quantity, recovery price, delivery parties, and contact information of the recovered product. The retention period of registration data is generally not less than 3 years. The record of the handover of waste electrical and electronic products is not clear, and the flow direction is difficult to trace back. The maximum penalty is 10,000 yuan.
